Man Ordered To Pay Victim Compensation After Vicious Attack

A 49 year old man has been ordered to pay his victim £3,000 in compensation after a vicious attack left him with extensive facial and dental injuries.

David Davenport kicked the victim several times in the head according to a witness, causing severe facial and dental injuries; the victim lost a tooth and suffered bruising and cuts and he will need extensive dental treatment, which is likely to cost a lot of money.

Mr Davenport’s girlfriend, Debbie Fairbrother, 25, was also arrested following the incident, which took place in Coalville last September.

In court in Leicester, CCTV footage of the incident was played out and the judge was told that words had been exchanged between Mr Davenport and the victim earlier in the night.

Mr Alan Murphy, for the prosecution, said that the CCTV footage showed the three people going into a shop and Ms Fairbrother waving her arms in the victim’s face after words were exchanged between him and her partner, Mr davenport. After leaving the shop, the victim was seen on the floor and a pub landlady, who was a short distance away across the road, said that she had seen Davenport kicking the man in the head at least three times; he was wearing sturdy work boots at the time and the victim was bleeding and struggled to stand up. He was also seen holding a tooth that had been knocked out and his eye was bruised and very swollen.

Mr Davenport called the police after the attack and he was arrested, along with Ms Fairbrother, at their home in Whitwick.

Mr Davenport was ordered to pay the victim £3000 in compensation plus £125 in costs and he was also sentenced to 18 months in jail, which will be suspended for 12 months. He pleaded guilty to causing actual bodily harm. Ms Fairbrother was given a 12 month community supervision order and ordered to pay £105 in costs.

In defence of Mr Davenport, Philip Gibbs, explained that his client had shown instant remorse by calling the police and John Hallissey, speaking for Fairbrother said that the incident stemmed from the fact that his client used to be friends with the victim’s wife, but the friendship had soured.
