Florida women loses case against Merck

A Florida woman who claimed that taking Fosamax caused her to experience jaw pain and dental health problems has lost her case, it has been announced.

Judith Graves took Merck to court in 2006 and claimed that taking the drug for osteoporosis had caused her to suffer extensive dental health problems and deterioration of the jaw tissue. Graves said the company had failed to advise doctors and patients that Fosamax was linked to jaw tissue degeneration. Graves underwent a series of surgical procedures to treat her problems; however, Merck claimed that her problems were linked to underlying health conditions.

In court in New York, the jury rejected the plaintiff’s case and said that Merck had acted in an appropriate manner. Mike Brock, the attorney representing Merck, said that Judith Graves’ health problems had been caused by underlying medical conditions and taking Fosamax had nothing to do with her dental and jaw problems.

This is the second case Merck has won out of three that have gone to trial. Hundreds of complaints have been made about Fosamax and it remains to be seen how many cases will reach trial.
