Birmingham dental receptionist wins case against employers

A dental receptionist, who claimed she lost her job because she was pregnant, has won her case.

Miss Saba Saeed, of Great Barr, Birmingham accused her former employers, Dr Farshid Shoja and Mrs Shoja-Assadi of Broadway Dental Practice of discriminating against her because she was female. The receptionist also insinuated that her employers had dismissed her as a result of her announcing she was pregnant.

In response to the allegations, Dr Shoja said Miss Saeed had intimidated other members of staff, made personal phone calls during work hours and spoken to colleagues in a rude and inappropriate manner.

Miss Saeed denied that she was rude to other members of staff and said that she had been treated unfairly by her employers, who had treated other employees in a much more favourable way. Miss Saeed also said she had been alienated as a result of other staff not wanting to work alongside her.

Saba Saeed filed the claims against Dr Shoja and Mrs Shoja-Assadi claiming they had dismissed her unfairly and did not have a valid reason to terminate her employment.

At the tribunal, judge Tom Roper, said Miss Saeed had indeed been discriminated against due to her sex and was also unfairly dismissed on the grounds that she had announced that she was pregnant; she was sacked just days after the announcement. The hearing lasted for two days and Miss Saeed was given compensation totalling £3,041; this sum included a 25 percent penalty, which was give non the grounds that Miss Saeed’s employers had not followed the guidelines set out under the Employment Rights Act.
