Discus Dental and Zap Lasers launch lawsuit against BIOLASE

Representatives from dental laser giant, BIOLASE, have announced that a lawsuit has been opened against them.

The lawsuit has been filed by Discus Dental LLC and Zap Lasers LLC; the companies have launched allegations of patent and trademark infringement that are associates with BIOLASE’s iLase diode laser technology. The allegations relate to the design of the instrument, rather than the technology involved; the shape of the iLase diode is apparently under scrutiny.

The iLase diode is an innovative laser instrument that was developed for dentists and hygienists; it is extremely powerful and allows dentists and hygienists to use laser technology to treat soft tissue problems and perform hygiene procedures without the use of any pedals or additional wires; it is the first self-contained laser instrument on the market.

Just last month, BIOLASE announced that it had received permission from the US Food and Drug Administration to actively market the iLase instrument; however, rival companies insist that the product is too similar to existing products and will consequently cause confusion amongst dentists, dental companies and consumers.

David Mulder, Chief Executive of BIOLASE maintains that the company is not breaking any rules and the iLase instrument is in fact, completely different to all other products currently available on the US market. In comparison to the other laser devices marketed by Zap and Discus Dental, the iLase is twice as powerful, has more features and is shaped differently; the iLase also has a number of adjustable tips, rather than one fixed tip. Mr Mulder believes that allegations have been made as a reaction to concern about not being able to compete with BIOLASE’s iLASE product. The court date has yet to be set.
